tätig keit. Dabei handelt es sich freilich nur um ein Postulat, das in der Rechts wirklichkeit voll nie erreicht werden kann. Der Cambridge- Professor Philip Allott schrieb überzeugend: «The capacity of human beings to recognize order – the order of the physical universe, of society, or morality, of law, of human persona- lity, of human consciousness – is the capacity to recognize the order of all order. And the order of the order of law is called justice.»7 Dann aber weist er auf die Fragilität des Gerechtigkeitsideals hin: «As they witness to the ideal of justice, courts, in everything they do, commit injustice ...The justice of a given society, the social ju- stice embodied in its law, is a shadow, and only a shadow, of the ju- stice of all justice ...A court is a blade of sacrifice.»8 Und das Gericht symbolisiert nach Allott die Warnung, «that there is a justice above and beyond the justice of the law, that the law is always a means and never an end. The voice that is heard in the court-room is the voice of law (lex loquens). Its echo is the voice of justice (ius loquens).»9 Was also ist Gerechtigkeit? Ich versuche, den Begriff in eine Verbin dung zum «Gesetz» und zum «Gericht» zu bringen, also gleichsam eine Brücke zu schlagen, deren eine Teil das Gesetz und der andere Teil die Institutionen der Justiz, vor allem der Verfassungs ge richts barkeit, bildet und die durch das Mittelstück der Gerechtigkeit zusammengehalten wird. Für die (verfassungs)rechtliche Analyse unserer letzt lich nie lösba- ren Thematik seien vier Thesen aufgestellt: – Gerechtigkeit bedeutet grundsätzlich Einhaltung der Gesetze. – Voraussetzung für die Legitimität der Gesetze ist, dass sie ihrerseits in einem «fairen» Verfahren zustande gekommen sind. – Aus nahmsweise kann sich der Gerechtigkeitsgedanke «korrektiv» ge- gen das (einfache) Gesetz wenden, dies insbesondere in Form verfas- 90Daniel
