Max Lerner schrieb zum Konzept des «Rule of law»: «The subjection of all public officials to a higher law that is ‹com- mon› not only in the sense that it is available to all men but also in the sense that it exempts no one was carried over into the American colonies, and it took the form here of the concept of the Constitu - tion as a ‹fundamental law›. It cropped up timorously in some of the early cases that are now cited as forerunners of 
Marbury v. Madi - son, and in that case it took its first long step towards being conver- ted into the doctrine of judicial review. It has been the principle ideological force bolstering judicial review as a necessary doctrine in a ‹government of laws and not of men›. It is an influence that lingers today in the minds of those who never heared of Coke, and who do not know the meaning – much less the ‹spirit› – of the common law.»29 Es ist kein Zufall, dass sich auch Archibald Cox, Sonderbeauftragter im Watergate-Prozess gegen Präsident Nixon, auf die lange, mit der «Magna Charta» einsetzende Geschichte des «Rule of Law» berief. Er erinnerte an die von Chief Justice Coke an König James I. erteilte Ant wort: «The King ought not to be under any man, but is under God and the Law.» Und er berief sich auf ein Dictum von Justice Robert H. Jack son: «With all its defects, delays and inconveniences, men have discover- ed no technique for long preserving free government except that the Exe cutive be under the law, and that the law be made by parlia- mentary deliberations.»30 Zur Klärung von Ungewissheiten über Fragen von Recht und Ge rech - tigkeit sehen wir uns unabdingbar auf die Figur des Richters verwiesen. Das besondere Verfahren des Verfassungsprozesses und die besondere Legitimation des Verfassungsrichters scheinen Gewähr dafür zu bieten, dass angesichts des jeweiligen konkreten Falles ein verantwortbares Urteil über die Verletzung oder Nichtverletzung des Willkür ver botes oder andere Gerechtigkeitstopoi gefällt 
wird.105
