Peter Häberle Dieser Passus zeigt besonders klar, welch hoher Integrationswert in einer Präambel stecken kann, wie hier nationale Lebensgeschichte "erzählt" wird, Grundwerte angerufen sind, und all dies in feierlichem Tön. Stolz auf die Vergangenheit, aber auch die spezifische Insellage sowie die Grundwerte konstituieren diesen Kleinstaat in einer unnachahmlichen Weise. Ein drucksvoll ist auch der Passus: "Nation ... in which no Man, Woman or Child shall ever be Slave or Bondsman to anyone or their Labour exploited or their Lives frustrated by deprivation..." Die Präambel erweist sich als
das Instrument der Identitätsgewinnung und -behauptung der kleinstaatlichen Variante des Verfassungsstaates, bis hin zum Glaubenshaften (ähnlich wie in vielen Entwicklungsländern). Eigenen Zuschnitt besitzt die Verf. von
Dominica (1978). Das zeigt sich schon in der Präambel, die es formal wie inhaltlich mit jeder verfassungs staatlichen Präambel grösserer Länder aufnehmen kann. Zitiert sei der Pas sus: "principles that acknowledge the supremacy of God, faith in funda mental rights and freedoms, the position of the family in a society of free men and free institutions, the dignity of the human person", der Satz: "there should be opportunity for advancement on the basis of recognition of merit, ability arid integrity" oder "recognize that men and institutions remain free only when freedom is foünded upon respect for moral and Spi ritual values and the rule of law". Auch der Gründrechtskatalog hat hohes Niveau (Art. 1 bis 17); ferner fällt die überaus präzise Regelung der "Con- stituency Boundaries and Electoral Commissions" auf (Art. 56, 57), ebenso die "Judicial Provisions" (Art. 103 bis 107) sowie der originelle "Parliamen- tary Commissioner" (Art. 108 bis 115). Die
Salomonen (Verf. von 1978) gleichen dem allgemeinen Textbild; ihre Präambel aber enthält , einige beachtliche Varianten: eine Art
kulturelles Erbe-Klausel in den Worten: "proud of the wisdom and the worthy customs of our ancestors, mindful of our. common and diverse heritage and conscious of our common destiny", sie berührt das Problem der
Ressourcenknappheit in dem Passus: "the natural resources of our country are vested in the people and the government of Solomon Islands", 136
